M/S Creative Capital Services Ltd, had filed a petition under Section 95 of the IBC before the Hon’ble National Company Law Tribunal (NCLT), New Delhi (Court IV), bearing petition number as C.P. (IB) No. 13/ND/2024 on 28.02.2023 for initiation of his insolvency resolution process.The said petition has been admitted by the Hon’ble bench vide its order dated 09.02.2024& through the same order, Taruna Goel has been appointed as the Resolution Professional. The order of the Hon’ble NCLT09.02.2024 Delhi (Court IV) has marked the beginning of the insolvency proceedings against Smt. Alka Goyal

In furtherance to the above, a report under section was filed by the RP on 23.02.2024. Ms Taruna Goel. On the recommendation of Taruna Goel, Resolution Professional through her report u/s 99 of the code submitted after examining the petition and the related documents, the Hon’ble NCLAT, Delhi Bench (Court IV) has admitted the petition & has passed order dated 09.08.2024 u/s 100 of the code for the commencement of Insolvency Resolution Process of Alka Goyal.

IMPOSITION OF MORATORIUM U/S 101 OF THE CODE
With the admission of application u/s 100, a moratorium has been commenced in relation to all the debts of Alka Goyal. Pursuant to the imposition of moratorium under Section 101 of the Code, no legal proceedings can continue or be initiated against the personal guarantor in respect of any debt; and the personal guarantor is barred from transferring, alienating, encumbering or disposing of any of his assets or his legal rights or beneficial interest therein.

In pursuance to the order of Hon'ble NCLT dated 09.08.2024, New Delhi Bench, Court IV, the Resolution Professional has caused a public announcement to invite claims from all the creditors of personal guarantor in two newspapers namely Amar Ujala and Financial Express.
